Act of God Provisions

“Force majeure” or “act of God” provisions state that the parties will be excused from performance of the contract if “an act of God,” such as a tornado, earthquake or hurricane, makes performance impossible.   A “force majeure” may also include human-caused events such as riots, acts of war or acts of terrorism.  Such provisions are acceptable, but they should apply to both parties.
